ENGLISH VERSION : General Terms and Conditions of Sale (GTCs)

1. Purpose

These General Terms and Conditions of Sale govern all sales made by Vice Run Co. through the website www.vicerunco.com. By placing and confirming an order, the Customer acknowledges having read and accepted these Terms and Conditions.

2. Products

Vice Run Co. offers running apparel for men and women. Photographs and descriptions are provided for illustrative purposes only; only the specifications listed on the relevant product page are contractually binding.

3. Prices

Prices are stated in euros (€). Vice Run Co. reserves the right to change its prices at any time. Products are invoiced at the prices applicable at the time the order is confirmed.

4.1 Orders

An order becomes final once payment has been successfully confirmed. Vice Run Co. reserves the right to cancel any order in the event of an existing dispute with the Customer, an obvious pricing error, or suspected fraud.

4.2 Pre-orders

Certain Products offered on the Website may be made available for pre-order prior to their availability or dispatch.

When confirming a pre-order, the Customer may be required to pay an amount corresponding to 50% of the total order value.

Unless expressly stated otherwise at the time of ordering, this amount is paid as a deposit (arrhes) within the meaning of Article L.214-1 of the French Consumer Code.

The pre-order results in the reservation of the relevant Products and their allocation to the Customer from the quantities produced or ordered by VICE RUN CO.

Except where the Customer exercises a statutory right of withdrawal arising from mandatory applicable law, the Customer may request cancellation of the pre-order before dispatch. In such case, the deposit (arrhes) already paid shall be retained by VICE RUN CO., and no further payment corresponding to the outstanding balance of the order shall be required.

Where VICE RUN CO. decides, on its own initiative, not to fulfil the pre-order, the consequences provided for under the applicable legal provisions governing deposits (arrhes) shall apply.

Availability and dispatch dates communicated in connection with a pre-order are estimates where they are expressly presented as such. VICE RUN CO. shall inform the Customer of any material change affecting the expected dispatch date, without prejudice to any rights granted to the Customer under mandatory applicable law.

5.1 Payment

Payment is made online using the payment methods offered on the Website, including credit or debit card, Apple Pay, and PayPal.

Payments are secured. Vice Run Co. does not retain any Customer banking information.

5.2 PRE-ORDERS AND PAYMENT TERMS

Certain Products offered on the Website may be made available for pre-order prior to their availability and dispatch.

a. Pre-order Confirmation

When confirming a pre-order, the Customer pays an amount corresponding to 50% of the total order value.

This amount is paid as a deposit (arrhes) within the meaning of Article L.214-1 of the French Consumer Code.

Successful payment of the deposit confirms the pre-order and results in the reservation of the relevant Products for the Customer. An order confirmation and payment confirmation are sent to the Customer by email.

b. Payment of the Remaining Balance

The remaining 50% of the total order value constitutes the outstanding balance of the pre-order.

By confirming the pre-order and making the initial payment, the Customer expressly authorises VICE RUN CO. to use the payment method registered in connection with the initial payment to charge the outstanding balance of the order.

Around the estimated dispatch date of the Products, the remaining balance will be automatically charged to the payment method used to pay the deposit.

The Customer will receive a new notification confirming payment of the remaining balance.

Where required by applicable regulations, the Customer's bank, or the payment service provider, additional authentication or action by the Customer may be required to complete this second payment.

If payment of the remaining balance is unsuccessful, VICE RUN CO. may contact the Customer to allow the outstanding amount to be settled using any payment method offered on the Website.

c. Pre-order Cancellation

Where a pre-order is cancelled by the Customer before dispatch, the deposit (arrhes) already paid shall be retained by VICE RUN CO., and no payment of the outstanding balance shall be required, subject to any mandatory statutory rights available to the Customer under applicable law.

Where VICE RUN CO. definitively cancels the pre-order on its own initiative, the applicable statutory provisions governing deposits (arrhes) shall apply.

d. Estimated Availability and Dispatch Dates

Any availability, dispatch, or delivery date stated in connection with a pre-order is an estimate where it is expressly presented as such.

VICE RUN CO. may inform the Customer of any material change affecting such estimate.

e. Order Dispatch

Once the outstanding balance has been paid in full and the Products are available, the order will be prepared and dispatched in accordance with the delivery method selected by the Customer.

Upon dispatch, the Customer will receive a confirmation email containing, where available for the selected shipping method, the information required to track the parcel.

6. Delivery

Delivery is available in France, throughout Europe, and internationally via Colissimo, Mondial Relay, FedEx, and DPD. Applicable delivery charges and estimated delivery times are displayed when placing the order.

Estimated average delivery time within France: approximately 3 business days, based on the average delivery times generally provided by Colissimo (D+2), Mondial Relay (~D+3), and DPD (~D+3). This timeframe is provided for information purposes only and may vary depending on the destination and period.

Once the parcel has been handed over to the carrier, Vice Run Co. will provide the Customer with a tracking number. The company accepts no liability for delays or loss occurring after the parcel has been handed over to the carrier, unless such loss results from proven fault on the part of the carrier or Vice Run Co.

7. Right of Withdrawal & Returns

In accordance with applicable law, the Customer has a period of 14 days from receipt of the goods to exercise their right of withdrawal.

Return Policy: Vice Run Co. does not offer refunds. The Customer may choose between:

• an exchange for a Product of the same value, with a price adjustment where necessary;

• or store credit valid for 12 months on the Website.

To qualify for a return, the Product must be returned in new condition, unworn and unwashed, with its original tags and packaging, together with proof of purchase.

Return shipping costs are borne by the Customer, except where the Product is defective or an incorrect Product has been sent, in which case Vice Run Co. will cover the return shipping costs.

8. Defective Products and Shipping Errors

If a Product is defective or an incorrect Product has been sent, please contact business@vicerunco.com, including photographs and the relevant order number.

In such cases, Vice Run Co. will offer a replacement free of charge or store credit.

9. Liability

Vice Run Co. takes reasonable measures to ensure the quality of the Products it sells.

Vice Run Co.'s liability is limited to the total value of the relevant order. Vice Run Co. shall not be held liable for any indirect damage arising from the use of the Products.

10. Intellectual Property

All content available on the Website, including texts, photographs, logos, and graphic designs, is the exclusive property of Vice Run Co.

Any unauthorised reproduction is prohibited.

11. Personal Data

The information collected is necessary for the processing and fulfilment of orders.

12. Governing Law and Disputes

These General Terms and Conditions of Sale are governed by French law.

In the event of a dispute, the competent courts shall be those within the jurisdiction of Bordeaux, France, subject to any mandatory statutory provisions to the contrary.

VERSION FRANCAISE : Conditions Générales de Vente (CGV)

1. Objet

Les présentes conditions générales de vente régissent l'ensemble des ventes effectuées sur le site www.vicerunco.com par Vice Run Co. En validant une commande, le client reconnaît avoir pris connaissance et accepté ces CGV.

2. Produits

Vice Run Co propose des vêtements de running pour hommes et femmes. Les photographies et descriptions sont indicatives ; seules les caractéristiques listées dans la fiche produit sont contractuelles.

3. Prix

Les prix sont indiqués en euros (€). Vice Run Co se réserve le droit de modifier ses prix à tout moment ; les produits sont facturés sur la base des tarifs en vigueur au moment de la validation de la commande.

4.1 Commande

La commande est définitive après validation du paiement. Vice Run Co se réserve le droit d’annuler toute commande en cas de litige avec le client, d’erreur manifeste sur le prix ou de suspicion de fraude.

4.2 Précommande

Certains Produits proposés sur le Site peuvent être commercialisés sous la forme de précommandes avant leur disponibilité ou leur expédition.

Lors de la validation d'une précommande, le Client peut être invité à verser une somme correspondant à 50 % du prix total de la commande.

Sauf indication contraire expressément mentionnée lors de la commande, cette somme est versée à titre d'arrhes au sens de l'article L. 214-1 du Code de la consommation.

La précommande entraîne la réservation des Produits concernés et leur allocation au Client dans le cadre des quantités produites ou commandées par VICE RUN CO.

En dehors de l'exercice d'un droit de rétractation prévu par une disposition légale impérative, le Client peut demander l'annulation de sa précommande avant son expédition. Dans ce cas, les arrhes déjà versées restent acquises à VICE RUN CO. et aucun paiement complémentaire correspondant au solde de la commande ne sera exigé.

Lorsque VICE RUN CO. renonce de sa propre initiative à exécuter définitivement la précommande, les conséquences prévues par les dispositions légales applicables aux arrhes s'appliquent.

Les dates de disponibilité et d'expédition communiquées lors de la précommande sont des estimations lorsqu'elles sont expressément présentées comme telles. VICE RUN CO. informe le Client de toute modification significative affectant la date prévue d'expédition, sans préjudice des droits dont bénéficie le Client en vertu des dispositions légales impératives applicables.

5.1 Paiement

Le paiement s’effectue en ligne via les moyens proposés sur le site : carte bancaire (CB), Apple Pay, PayPal. Les paiements sont sécurisés. Aucune donnée bancaire n’est conservée par Vice Run Co.

5.2 PRÉCOMMANDES ET MODALITÉS DE PAIEMENT

Certains Produits proposés sur le Site peuvent être commercialisés sous forme de précommande avant leur disponibilité et leur expédition.

a. Validation de la précommande

Lors de la validation d'une précommande, le Client verse une somme correspondant à 50 % du prix total de la commande.

Cette somme est versée à titre d'arrhes au sens de l'article L. 214-1 du Code de la consommation.

L'encaissement de ces arrhes confirme la précommande et entraîne la réservation des Produits concernés au bénéfice du Client. Une confirmation de commande et de paiement est adressée au Client par courrier électronique.

b. Paiement du solde

Les 50 % restant dus constituent le solde de la précommande.

En validant sa précommande et en procédant au premier paiement, le Client autorise expressément VICE RUN CO. à utiliser le moyen de paiement enregistré lors de ce premier règlement afin de procéder au paiement du solde de la commande.

À l'approche de la date estimée d'expédition des Produits, le solde est automatiquement débité sur le moyen de paiement utilisé lors du versement des arrhes.

Le Client reçoit une nouvelle notification confirmant le paiement du solde.

Lorsque la réglementation applicable, l'établissement bancaire du Client ou le prestataire de paiement l'exige, une authentification ou une action complémentaire du Client peut être nécessaire afin de finaliser ce second paiement.

En cas d'échec du paiement du solde, VICE RUN CO. pourra contacter le Client afin de lui permettre de régulariser le règlement par tout moyen de paiement proposé sur le Site.

c. Annulation de la précommande

En cas d'annulation de la précommande à l'initiative du Client avant son expédition, les arrhes déjà versées restent acquises à VICE RUN CO. et aucun paiement du solde restant ne sera exigé, sous réserve des droits impératifs dont bénéficie le Client en vertu de la législation applicable.

En cas d'annulation définitive de la précommande à l'initiative de VICE RUN CO., les dispositions légales applicables aux arrhes s'appliquent.

d. Dates estimées de disponibilité et d'expédition

Toute date de disponibilité, d'expédition ou de livraison indiquée pour un Produit en précommande constitue une estimation lorsqu'elle est présentée comme telle.

VICE RUN CO. pourra communiquer au Client toute évolution significative de cette estimation.

e. Expédition de la commande

Une fois le solde intégralement réglé et les Produits disponibles, la commande est préparée puis expédiée selon les modalités de livraison sélectionnées.

Lors de l'expédition, le Client reçoit un courrier électronique de confirmation comprenant, lorsque le mode de transport le permet, les informations nécessaires au suivi de son colis.

6. Livraison

Livraison en France, en Europe et à l’international via Colissimo, Mondial Relay, FEDEX et DPD. Les frais de livraison et délais applicables sont indiqués lors de la commande.

Délai moyen estimé en France : environ 3 jours ouvrés (moyenne calculée à partir des pratiques des transporteurs Colissimo (J+2), Mondial Relay (~J+3) et DPD (~J+3). Ce délai est donné à titre indicatif et peut varier selon la destination et la période.

Une fois le colis remis au transporteur, Vice Run Co fournit un numéro de suivi. La société décline toute responsabilité en cas de retard ou de perte après dépôt chez le transporteur, sauf si la perte est due à une faute prouvée du transporteur ou de Vice Run Co.

7. Droit de rétractation & Retours

Conformément à la législation, le client dispose d'un délai de 14 jours à compter de la réception du bien pour exercer son droit de rétractation.

Politique de retour : Vice Run Co n'effectue pas de remboursement. Le client peut choisir entre :

• un échange (produit de même valeur ou ajustement prix si nécessaire),
• ou un avoir valable 12 mois sur le site.

Conditions pour accepter un retour : le produit doit être retourné dans un état neuf (non porté, non lavé), avec ses étiquettes et emballage d’origine, accompagné du justificatif d’achat. Les frais de retour sont à la charge du client, sauf en cas de produit défectueux ou erreur d’envoi, où Vice Run Co prendra en charge l’expédition retour.

8. Produits défectueux et erreurs d'envoi

Si un produit est défectueux ou s’il y a erreur d’envoi, contactez business@vicerunco.com en joignant photos et numéro de commande. Dans ces cas, Vice Run Co proposera un échange à titre gratuit ou un avoir.

9. Responsabilité

Vice Run Co veille à la qualité des produits commercialisés. La responsabilité de Vice Run Co est limitée au montant de la commande. Vice Run Co ne saurait être tenue responsable des dommages indirects liés à l’utilisation des produits.

10. Propriété intellectuelle

Tous les contenus du site (textes, photos, logos, créations graphiques) sont la propriété exclusive de Vice Run Co. Toute reproduction non autorisée est interdite.

11. Données personnelles

Les informations collectées sont nécessaires au traitement des commandes. Pour plus de détails, consulter la Politique de confidentialité.

12. Droit applicable et litiges

Les présentes CGV sont soumises au droit français. En cas de litige, les tribunaux compétents seront ceux du ressort de Bordeaux (France), sous réserve des dispositions impératives contraires.
